1) Acceptance of Terms
By accessing or using the EcoPaw Pups website, mobile site, or services (collectively,
the “Site”), you agree to these Terms of Service (“Terms”), our Privacy Policy, and all
additional policies referenced herein (collectively, the “Agreement”). If you do not agree,
do not use the Site.
2) Eligibility
You must be at least 18 years old and capable of entering into a binding contract. If you
use the Site on behalf of a business, you represent that you have authority to bind that
entity.
3) Account Registration & Security
To make purchases or use certain features, you may need an account. You agree to
provide accurate information and maintain the confidentiality of your account
credentials. You’re responsible for all activities under your account.
4) Product Information & Availability
We strive to display product details accurately. However, colors, materials, and
packaging may vary slightly. Prices, promotions, and availability are subject to change
without notice. We reserve the right to limit or cancel orders for any reason, including
suspected fraud or resale.
5) Pricing, Taxes & Promotions
Prices are in U.S. dollars unless stated otherwise. Taxes, duties, and shipping fees apply
as indicated. You’re responsible for any applicable local sales or import taxes.
Promotions and discounts may have specific terms and can be changed or canceled at
any time.
6) Orders & Payment
Placing an order constitutes an offer to purchase. We may accept or decline your order
at our discretion. A confirmation email acknowledges receipt; acceptance occurs when
your order ships. You authorize us and our payment processors to charge your selected
payment method for all purchases.
7) Shipping, Delivery & Risk of Loss
Shipping options, costs, and estimated delivery times are shown at checkout. Title and risk of loss transfer to you when we deliver to the carrier. Delivery dates are estimates only. International orders may be subject to customs clearance delays or import fees.
8) Returns, Exchanges & Refunds
We want you and your pup to be happy. You may return or exchange eligible products
within 30 days of delivery. Products must be unused, in original packaging, and include
proof of purchase. Certain items (e.g., wipes and/or opened products) are final sale for
safety and hygiene reasons. To initiate a return, email friends@ecopawpups.com with
your order number. Refunds will be issued to the original payment method after
inspection. Shipping fees are non-refundable, except for defective or incorrect items.
California residents retain all rights under the California Consumer Legal Remedies Act
(CLRA) and other applicable consumer laws.
9) Subscriptions & Auto-Renewals (If Applicable)
If you subscribe for recurring deliveries, your plan will renew automatically until
canceled. You authorize recurring charges to your payment method. You can cancel
anytime in your account settings before the next billing date.
10) Gift Cards & Store Credit
Gift cards are valid only on our website, not redeemable for cash (except as required by
California law). Lost or stolen cards will not be replaced without proof of purchase.
11) User Content
You may post reviews, comments, photos, or other content (“User Content”). By
submitting it, you grant EcoPaw Pups a worldwide, royalty-free, perpetual license to use
and display it for marketing and promotional purposes. You’re responsible for the
accuracy and legality of your submissions.
12) Acceptable Use
You agree not to: violate any laws; misuse or disrupt the Site; upload harmful code;
infringe IP rights; or use the Site for unauthorized commercial purposes.
13) Intellectual Property
All content, trademarks, and branding on the Site are owned by EcoPaw Pups or its
licensors. You may not copy, distribute, modify, or use any part of the Site without prior
written consent.
14) Environmental & Safety Information
Our products may include statements like “plant-based,” “biodegradable,” or
“compostable.” Performance depends on proper use and local facilities. Always follow
packaging instructions and local waste guidelines. Keep all products and packaging
away from children and use products only as directed.
15) Third-Party Services
We use trusted third-party providers for payment processing, shipping, and analytics.
We’re not responsible for their actions or content. Your interactions with them are
governed by their own terms and policies.
16) Communications
By providing your email or phone number, you agree to receive transactional updates.
Marketing messages require separate opt-in consent. You can unsubscribe anytime.
Standard carrier or data rates may apply.
17) Privacy
Your information is handled according to our Privacy Policy available at [insert link].
18) Disclaimer of Warranties
To the maximum extent permitted by California law, the Site and all products are
provided “AS IS” without warranties of any kind, express or implied.
19) Limitation of Liability
EcoPaw Pups is not liable for any indirect, incidental, special, consequential, or punitive
damages. Our total liability will not exceed the total amount you paid for the product(s)
in question during the 12 months before the claim.
20) Indemnification
You agree to indemnify and hold harmless EcoPaw Pups and its affiliates against all
claims or damages arising from your misuse of the Site or violation of these Terms.
21) Force Majeure
We’re not responsible for delays or failures caused by events beyond our reasonable
control.
22) Dispute Resolution; Arbitration; Class Action Waiver
Any dispute will be resolved through binding arbitration administered by the Judicial
Arbitration and Mediation Services, Inc. (“JAMS”) in Los Angeles, California. You waive
any right to a jury trial or class action. You may opt out by sending written notice to
friends@ecopawpups.com within 30 days of your first purchase.
23) Governing Law & Venue
These Terms are governed by California law. Legal actions will be brought exclusively in
the state or federal courts of Los Angeles, California.
24) Changes to the Terms
We may update these Terms at any time. Updates will be posted with a new Effective
Date. Continued use of the Site after such changes constitutes acceptance.
25) Termination
We may suspend or terminate your account for violations of these Terms. Relevant
sections such as IP, indemnification, and dispute resolution will survive termination.
26) Entire Agreement
These Terms, along with our Privacy Policy and referenced policies, form the complete
agreement between you and EcoPaw Pups. If any provision is invalid, the remainder
remains enforceable.
